The terms and conditions are as follows: (1) Assuming all of these terms and conditions are met, TradeStation Securities shall give Customer a credit against brokerage commissions charged to Customer equal to 20% of those commissions, and those credits shall continue until the total amount of credits equals the purchase price the Customer has paid for the qualified Schaeffer’s Investment Research product; (2) Customer has, or is approved to open and funds, within 180 days following purchase of qualified Schaeffer’s Investment Research product, a TradeStation brokerage account; (3) Schaeffer’s Investment Research has provided to TradeStation Customer’s name, address, phone number and email address, the product name, and the price paid by Customer for that product, within 30 days following the purchase; (4) Commission credits apply only to TradeStation’s full, published, non-discounted commission rates, and if Customer receives discounts, promotions, reimbursements, waivers or other concessions that in effect reduce or reimburse (in whole or in part) those full, published rates, no 20% or other credit will be given; (5) With respect to TradeStation futures brokerage accounts, the 20% credit is applied to the portion of the commission charge in excess of the exchange and regulatory fees that are included in those commissions, and in no event will Customer be entitled to a commission that is lower than 25 cents per contract, per side (in excess of the exchange/regulatory fees); (6) Commission credits will be applied in the month following the month the full commissions are charged; and (7) commission credits are not available, even if the full purchase amount has not been reached, after Customer closes Customer’s account or fails to maintain a minimum asset balance of $2,500, or if any TradeStation account of Customer is closed or deemed closed or otherwise prohibited from making further trades in the account by TradeStation, or is considered by TradeStation not to be in good standing (as result of, for example, unpaid margin calls or debits, unauthorized or improper trading or account activity, or the assertion of monetary claims against TradeStation). TradeStation is under no obligation to open or continue to maintain any account for Customer.
